The “Jockey UnderWars” Tournament (the “Tournament”) is open to any legal resident of the United States or the District of Columbia, 18 years of age or older. Each person in a video or otherwise participating in the Tournament must meet these eligibility requirements and comply with these Rules and with the JockeyUnderWars.com website Terms of Use. Participants must submit a complete Tournament Entry Form, including their video, and Participants must have access to a valid e-mail account and Internet access throughout the Tournament Period. Participants will be notified by e-mail only to the e-mail address provided at the time of entry. Employees, suppliers, representatives and agents of Jockey International, Inc., (“Jockey”) (“Sponsor”) and its participating retailers, and their respective advertising, promotion and judging agencies, and their respective immediate families or persons living in the same household, are not eligible to enter and win. Contest winner(s) of any previous Jockey UnderWars Tournament is/are not eligible to enter and win. Void where prohibited or restricted by law.
The Entry Period for the Tournament begins at 12:00 AM (Central Time (“CT”)) on December 28, 2007, and ends at 11:59 PM CT on April 10, 2008, or when a total of 16 eligible entries are received, whichever occurs first (“Entry Period”). Jockey reserves the right, at its sole discretion, to extend the Entry Period if required to receive a total of 16 eligible entries, or to decrease the total number of eligible Participants, as reasonably necessary to carry out the legitimate operation of this Tournament. During the Entry Period, visitwww.JockeyUnderWars.com (“Website”), complete the Tournament Entry Form, provide all required information, and submit the form and a video following the on-screen guidelines, available at http://jockeyunderwears.com/tos. Online tournament only. Only entries received and confirmed by e-mail through the Website are valid. Any entry received through any other Jockey website or e-mail address, by mail, facsimile or any other means is void. Limit one (1) entry per person, per group, per e-mail address submitted by the Authorized Account Holder. Any person or group who enters with multiple e-mail addresses, using different names will be disqualified. One or any number of people may appear in one (1) video subject to these Rules and the Terms of Use. Any person or persons who appear in more than one (1) Tournament video will be disqualified. Jockey, Periscope, Inc., and Internet Exposure (“Tournament Administrators”) will not verify entry receipt. All entries submitted become the sole property of Sponsor, subject to these Rules and the Terms of Use.
Tournament begins at 12:00 AM (Central Time ("CT")) on April 14, 2008, and ends at 11:59 PM CT on May 2, 2008, unless otherwise changed as may be necessary, in Sponsor's sole discretion, for administration of the Tournament.
There will be a total of 16 Participants randomly placed throughout one (1) Tournament bracket of eligible Participants. There will be at least three (3) rounds of voting including a fourth (4th) Championship Round to determine one (1) winner. Each person can vote once per day, per match from one (1) Authorized Account. Participants and any other person voting in the Tournament cannot vote from multiple accounts and/or multiple e-mail addresses. Any Participant voting from multiple accounts and/or multiple e-mail addresses will be immediately disqualified, and all of that Participant’s accounts will be terminated. Sponsor reserves the right to delete votes and to terminate all accounts from any other person voting or otherwise participating in the Tournament who votes from multiple accounts and/or multiple e-mail addresses. Sponsor is under no obligation to give prior notice to disqualify a Participant, terminate Participant’s account(s) and/or terminate any other person’s account(s).
Jockey, whose decisions are final in all matters relating to this Tournament, will tally the votes and determine which Participant received the most votes during each Voting Period. The Participant with the most votes during each Voting Period advances to the next voting round. The Tournament winner is the Participant with the most votes during the championship round. The Voting Period for each round is as follows:
If a total of 16 eligible Participants are not received, Jockey reserves the right to modify the number of Participants, Tournament brackets, Voting Periods or otherwise suspend, cancel or terminate the Tournament in accordance with these Rules.
The Tournament will have one (1) winner, who shall win $25,000.00 (“Prize”). All federal, state and local taxes on the Prize are the Tournament Winner’s responsibility. Jockey will issue a 1099 tax form for the value of the Prize. Prize is non-transferable. No Prize substitution is allowed. Jockey reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. The odds of winning are 1:16.
After the conclusion of the Championship Round Voting Period, Jockey shall use reasonable efforts to contact the Initial Tournament Winner within seven (7) business days on or before May 12, 2008. Jockey reserves the right, at its sole discretion, to deem the Initial Tournament Winner’s prize forfeited and to select an alternate winner for any of the following reasons:
Initial Tournament Winner shall be required to sign an acknowledgment of eligibility and publicity release form, including address and Social Security number for issuance of tax forms, and return such document by the date indicated on the prize notification materials. Except where prohibited by law, the Tournament Winner’s entry and acceptance of the Prize constitutes his/her consent and permission for Jockey and its designees to use his/her first name, likeness and address (city and state), and demographics, in any manner that does not reveal winner’s identity for advertising, promotional and publicity purposes for this or similar promotions in perpetuity, worldwide and without restrictions, free from the payment of any additional compensation, notification or permission.
In the event the Initial Winner’s prize is forfeited, Jockey will award the Prize to the runner-up of the Championship Round. If the Prize to the runner-up is forfeited, Jockey will award the prize to the remaining eligible Participant whose video received the highest number of total votes through-out all Voting Periods. Awarding of the prize to an alternate winner is subject to these Rules.
This Tournament is subject to all applicable federal, state and local laws. By entering in this Tournament, Participants agree to be bound by these Rules and the decisions of the Sponsor and Tournament Administrator(s), which rules and decisions are final and binding on all Participants, and to waive any right to claim ambiguity in the Tournament or these Rules. Jockey reserves the right, at its sole discretion, to change these Rules to modify the Voting Period or for any other reason Jockey deems reasonably necessary to carry out the legitimate operation of this Tournament as planned. Jockey shall send a reasonable notice to all Participants of changes to these Rules, Tournament participation, Voting Periods and/or for any other reason Jockey deems reasonably necessary to carry out the legitimate operation of this Tournament as planned.
Jockey is not responsible and is under no obligation to confirm the validity of any e-mail address or to contact the Participant for a valid e-mail address for any reason. Jockey is not responsible for any lost, late, illegible, or misdirected entries or e-mail, nor for any electronic miscommunications or failures, technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions which may limit a Participant’s ability to participate in this program or any other person’s ability to vote for a Participant or otherwise participate in this Tournament. Entries that are damaged, altered, tampered with, illegible, contain printing errors, or submitted in a fraudulent manner are void.
By Participating, Participants agree to release and hold harmless Jockey; its respective subsidiaries; and each of its respective directors, officers, attorneys, employees, and agents, from any damage, injury, death, loss or other liability that may arise from Participants’ acceptance or use of any prize or participation in this Tournament, or from the misuse or malfunction of any merchandise received.
Jockey may void a Participant’s entry and/or prohibit a Participant from participating in the Tournament or winning the Prize if, in its sole discretion, it determines that the Participant is attempting to undermine the legitimate operation of the Tournament by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Participants or Jockey or for any violation of the Terms of Use. If, for any reason this Tournament is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes which corrupt in any way or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the Tournament, then Jockey reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Tournament. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, JOCKEY RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
All entries, comments and other submissions disclosed, submitted or offered in connection with this Tournament (collectively, "Submissions") shall be and remain Jockey’s property. Such Submissions shall constitute an assignment to Jockey, of all worldwide right, title and interest in all copyrights and other intellectual properties you have in the Submissions, subject to any third party rights. Thus, Jockey will own exclusively all such right, title and interest and shall not be limited in any way in its use, commercial or otherwise, of any Submissions, subject to any third party rights. Jockey is and shall be under no obligation (1) to maintain any Submissions in confidence; (2) to pay the Participant any compensation for any Submissions; or (3) to respond to any user Submissions.
You agree that no Submissions provided by you will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). You further agree that no submissions submitted by you will be or contain libelous or otherwise unlawful, abusive or obscene material. You are and shall remain solely responsible for the content of any Submissions you make.

This Tournament is governed by the laws of the State of Wisconsin for Participants who are legal residents, and located in the United States.

The name(s) of the winner(s) of the first Jockey Underwars Tournament, ending December 11, 2007, will be posted on the Website on or before January 1, 2008. The name(s) of the winner(s) of the second Jockey Underwars Tournament, ending May 1, 2008, will be posted on the Website on or before May 31, 2008. The names of all of the winners from each Tournament will remain available at least until September 30, 2008.
The Administrators of this Tournament is/are Jockey International Inc., Periscope, Inc., and Internet Exposure, which created and jointly maintain the Jockey UnderWars.com website and entries.
